Terms and conditions of sale

These terms and conditions of sale govern the sharpening services offered by Togi Toki on the togitoki.com website. They apply to every order placed on the website.

Article 1 – Identity of the provider

The service is provided by Jordan D’Osualdo, a sole trader (micro-enterprise) trading under the name Togi Toki, with its place of business at 45 rue du Château, 01640 Saint-Jean-le-Vieux, France, registered with the RNE under SIRET number 943 001 552 00018.

Article 2 – Purpose and scope

Togi Toki offers a craft sharpening service for blades (knives, pruning shears, wood chisels and gouges), carried out by hand on natural Japanese water stones (toishi).

These terms apply to every order placed by a customer, whether a business or a consumer, on the website. Placing an order implies full acceptance of these terms, which are available on the website at any time.

Article 3 – Services and formulas

The services are described on the dedicated pages of the website. They are organised into formulas according to the number of pieces to be sharpened, supplemented by per-piece finishing options. The essential features of each service appear on the corresponding page.

Some blades that are too damaged or made in a way that cannot be sharpened may not be accepted. In that case, the customer is informed before any work is carried out.

Article 4 – Prices

Prices are shown in euros. VAT not applicable, Article 293 B of the French General Tax Code (VAT exemption scheme).

Outward and return shipping are included in every formula. No additional shipping charge is billed to the customer.

The applicable price is the one in force when the order is confirmed. Togi Toki reserves the right to change its prices at any time, with no effect on orders already confirmed.

Article 5 – Orders

Orders are placed online on the website. The customer selects the service and options, reviews the summary, then confirms and pays. Confirmation of payment forms the contract.

A confirmation email summarising the order is sent to the customer. Togi Toki reserves the right to refuse or cancel any order on legitimate grounds (a prior dispute, a request that is clearly impossible to fulfil).

Article 6 – Payment

Payment is made online when the order is placed, by card via Stripe or via PayPal. Transactions are secured by these payment providers. Togi Toki never has access to the customer’s full bank card details.

Article 7 – Sending blades and performance of the service

After the order is confirmed, the customer receives packing and shipping instructions by email. It is the customer’s responsibility to protect each blade carefully and to send the parcel via the Mondial Relay point of their choice.

The sharpening service begins when the blades reach the workshop. Sharpening takes around 48 hours from receipt. The total time, including the outward and return journeys, is estimated at 7 to 8 days. These times are indicative and depend in particular on the carrier.

The customer is responsible for the suitability and safety of the packaging when sending. Togi Toki returns the blades with the same care.

Article 8 – Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, a consumer customer has a period of fourteen (14) days from the conclusion of the contract to exercise their right of withdrawal, without having to give a reason.

The customer may request that performance of the service begins before the end of this period. In accordance with Article L221-25 of the French Consumer Code, if the service is fully performed before the end of the withdrawal period, with the customer’s express prior agreement and their acknowledgement that they lose the right of withdrawal, that right can no longer be exercised. Where performance is partial, the customer remains liable for the amount corresponding to the service already provided.

To exercise the right of withdrawal, the customer notifies their decision by an unambiguous statement to contact@togitoki.com. Reimbursement is made within a maximum of fourteen (14) days following withdrawal, using the same means of payment.

[TO BE REVIEWED BY A LAWYER: the exact treatment of the right of withdrawal for a sharpening service carried out on the customer’s own property deserves checking, in particular how it interacts with the exceptions in Article L221-28 of the French Consumer Code.]

Article 9 – Legal guarantees

A consumer customer benefits from the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code), under the conditions provided by law.

If the customer considers that the service does not match what was agreed, they inform Togi Toki, who undertakes to examine the request and propose a suitable solution.

Article 10 – Liability

Togi Toki does everything possible to sharpen each blade to a high standard. Its liability cannot be engaged for damage occurring during transit due to inadequate packaging by the customer, nor for pre-existing wear or defects in the blades that are not attributable to the service.

Article 11 – Personal data

The customer’s personal data is processed in accordance with the Privacy policy available on the website and with the General Data Protection Regulation (GDPR).

Article 12 – Mediation and dispute resolution

In the event of a dispute, the customer first sends a written complaint to Togi Toki in order to seek an amicable solution.

In accordance with Articles L611-1 et seq. of the French Consumer Code, a consumer customer may use a consumer mediator free of charge:

Article 13 – Governing law

These terms are governed by French law. Failing an amicable settlement, the French courts shall have jurisdiction.
